Terms of Service

Thank you for using the MyFANOSS platform (the "Platform"), a private daily FANOSS check-in journal for couples in recovery, available at www.myfanoss.com.

To be eligible to register for a MyFANOSS account and use the Platform, you must review and accept the terms of this MyFANOSS Terms of Service (this "Agreement" or these "Terms"). PLEASE REVIEW THESE TERMS CAREFULLY. BY ACCEPTING THESE TERMS OR USING THE PLATFORM, YOU AGREE TO THESE TERMS AND CONDITIONS WITH MYFANOSS ("MyFANOSS", "we", "us", or "our"). IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, YOU SHOULD NOT USE THE PLATFORM.

MyFANOSS may revise these Terms from time to time. If MyFANOSS does revise these Terms, the revised Terms will supersede prior versions. Revisions will be effective upon the effective date indicated at the top of these Terms. If we make material changes, we will notify you within the app or via email. Your continued access or use of the Platform constitutes your acceptance of any revisions. If you do not agree to the revisions, you should stop using the Platform.

Your Privacy

We do not sell, share, or use your personal data for any purpose other than providing this service to you. Your journal entries, feelings, affirmations, and all other information you enter are strictly confidential and belong to you. We will never access your entries for marketing, analytics, or any other purpose. All entry content is encrypted in your browser before being sent to our servers — we cannot read your journal data. Account and Access

Subject to the terms and conditions of this Agreement, MyFANOSS grants you a non-exclusive, non-transferable right to access and use the Platform for your personal use. You are responsible for (a) maintaining the confidentiality of your account credentials and encryption passphrase, (b) all activity that occurs under your account, and (c) your compliance with this Agreement.

Data Security

MyFANOSS will maintain a security program designed to (i) ensure the security and integrity of your data; (ii) protect against threats or hazards to the security or integrity of your data; and (iii) prevent unauthorized access to your data. All journal content is encrypted client-side using AES-256-GCM encryption before storage. We take every reasonable precaution to protect your data, including encrypted connections, secure authentication, and access controls. However, no system is 100% secure. By using this service, you acknowledge that you use MyFANOSS at your own risk.

Your Data, Your Control

You exclusively own all right, title, and interest in and to your data, including your journal entries, personal information, and any other content you submit to the Platform. You may delete individual entries, all your data, or your entire account at any time from the Settings page. When you delete your data, it is permanently removed from our systems.

Encryption and Passphrase

Your check-in entries are encrypted using a passphrase that only you (and your partner, if you choose to share it) know. We do not store your passphrase and cannot recover it. If you lose your passphrase, your encrypted data cannot be recovered. You are solely responsible for maintaining your passphrase and sharing it appropriately with your partner.

Sharing With Your Partner

Entries you create are private by default. You choose what to share with your linked partner. We will never share your entries without your explicit action. When you share an entry, your partner can view it only if they have the shared encryption passphrase.

Restrictions

You will not, directly or indirectly:

  • Reverse engineer, decompile, disassemble, modify, or create derivative works of the Platform;
  • Attempt to probe, scan, or test the vulnerability of the Platform, or breach the security or authentication measures of the Platform without proper authorization;
  • Attack, or attempt to attack, the Platform using a denial-of-service attack or any other attack;
  • Use the Platform to engage in any illegal activity, to infringe or violate any third-party rights, or otherwise outside the scope expressly permitted hereunder;
  • Share, transfer, distribute, resell, lease, license, or assign your account or access to the Platform.

Fees and Payment

MyFANOSS offers both free and premium subscription tiers. If you purchase a premium subscription, all fees are quoted and payable in United States dollars, all payment obligations are non-cancelable, and, except as expressly set forth herein, all fees paid are non-refundable. Payment is processed by Stripe. By providing your payment information, you (a) represent and warrant that such information is true and that you are authorized to use the payment instrument, and (b) authorize MyFANOSS (through Stripe) to bill your payment instrument in accordance with the terms of the applicable payment plan. You may manage, cancel, or reactivate your subscription at any time through the Stripe Customer Portal accessible from the Settings page.

Use of This Service

MyFANOSS is a personal journaling tool designed to support couples in sexual sobriety recovery. It is not a substitute for professional counseling, therapy, or medical advice. If you or someone you know is in crisis, please contact a qualified professional.

Intellectual Property

As between you and MyFANOSS, MyFANOSS exclusively owns all right, title, and interest in and to the Platform, its software, design, documentation, and all related intellectual property. Except for the express rights granted hereunder, MyFANOSS reserves all rights, title, and interests in and to the Platform.

Feedback

You may from time to time provide suggestions or comments for enhancements, improvements, new features, or other feedback ("Feedback") with respect to the Platform. MyFANOSS will have full discretion to determine whether or not to proceed with the development of any requested enhancements or features. MyFANOSS will have the right to use, incorporate, and otherwise fully exercise and exploit any such Feedback in connection with its products and services. All Feedback is provided "AS IS" and MyFANOSS will not publicly identify you as the source of Feedback without your permission.

Disclaimers

EXCEPT AS EXPRESSLY SET FORTH HEREIN, THE PLATFORM IS PROVIDED "AS IS" TO THE FULLEST EXTENT PERMITTED BY LAW, AND MYFANOSS HEREBY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE IN RELATION TO THE PLATFORM.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, UNDER NO LEGAL THEORY, WHETHER IN TORT, CONTRACT, OR OTHERWISE, WILL MYFANOSS BE LIABLE TO YOU FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOSS OF USE, LOST PROFITS, OR INTERRUPTION OF SERVICE, EVEN IF INFORMED OF THEIR POSSIBILITY IN ADVANCE, OR (B) ANY AGGREGATE LIABILITY IN EXCESS OF THE AMOUNTS PAID BY YOU DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Termination

You may terminate your account at any time by deleting your account from the Settings page. MyFANOSS may also terminate or suspend your access to the Platform upon written notice in the event you commit any material breach of this Agreement and fail to remedy such breach within thirty (30) days after written notice of such breach. Upon termination, all rights and obligations will immediately terminate except that any terms or conditions that by their nature should survive such termination will survive, including terms relating to intellectual property, disclaimers, limitations of liability, and the general provisions below.

General Provisions

  • Governing Law. This Agreement will be governed by the laws of the State of California, exclusive of its rules governing choice of law and conflict of laws.
  • Assignment. You may not assign or otherwise transfer this Agreement without our prior written consent.
  • Waiver. No waiver of any rights hereunder will be effective unless agreed to in writing. Failure or delay by either party to enforce any provision of this Agreement will not be deemed a waiver of future enforcement of that or any other provision.
  • Severability. If a court of competent jurisdiction determines that any provision of this Agreement is invalid, illegal, or otherwise unenforceable, such provision will be enforced as nearly as possible in accordance with the stated intention of the parties, while the remainder of this Agreement will remain in full force and effect.
  • Entire Agreement. This Agreement comprises the entire agreement between you and MyFANOSS with respect to its subject matter, and supersedes all prior and contemporaneous proposals, statements, and agreements (oral and written).
  • Force Majeure. Excluding payment obligations, neither party will be deemed in breach hereunder for any cessation, interruption, or delay in the performance of its obligations due to causes beyond its reasonable control, including earthquake, flood, or other natural disaster, act of God, labor controversy, civil disturbance, terrorism, war, cyber attacks, or the inability to obtain sufficient supplies, transportation, or other essential services.
